These Terms of Use (the “Terms”) govern access to and use of Philologica (the “Platform”), available at philologica.com. By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

2) Service Description
Philologica provides text analysis and editorial assistance tools, including generative AI features. Outputs are indicative and may require human review and independent verification.
3) Minimum Age (13+)
You must be at least 13 years old to use Philologica. If you are between 13 and 17, you represent that you have parental/guardian authorization where required by law. Users under 13 are not permitted.
4) Account and Security
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us if you suspect unauthorized access.
5) User Content
You retain ownership of your content. You grant us a limited, non-exclusive license to process it solely to provide the service, generate results, ensure security, and comply with legal obligations. You are responsible for having the necessary rights to upload and process your content.
6) AI Usage (Google Gemini)
By using AI features, you agree that your content may be processed by third parties (e.g., Google) acting as processors/subprocessors. Do not input trade secrets or highly confidential information. AI outputs may be incorrect and must be validated.
7) Acceptable Use
You must not use the Platform for unlawful purposes, to distribute malware, attempt unauthorized access, infringe intellectual property, or violate rights of others. We may suspend or terminate accounts for abuse or security risks.
8) Availability
The Platform may evolve and may be unavailable at times due to maintenance or technical issues. We do not guarantee uninterrupted availability.
9) Payments
If paid features are enabled, payments are processed via Stripe. Applicable prices and conditions are shown before purchase.
10) Withdrawal (EU – 14 days)
If you are an EU consumer, you may have a 14‑day withdrawal right unless the digital service starts immediately with your prior express request and acknowledgement that you may lose the right of withdrawal once performance begins.
11) Intellectual Property
Platform software, design, and content are protected by intellectual property laws. No rights are granted beyond those necessary to use the Platform under these Terms.
12) Third Parties
The Platform integrates third‑party services (e.g., Google, Stripe), which may have their own terms and policies.
13) Limitation of Liability
The Platform is provided “as is”. To the maximum extent permitted by law, we are not liable for indirect damages or losses arising from use of the Platform or AI outputs. Liability, where permitted, is limited to the amounts paid by you in the relevant period.
14) Indemnification
You agree to indemnify and hold us harmless from claims arising from your content or misuse of the Platform.
15) Termination
We may suspend or terminate your access for breach of these Terms or security risks.
16) Governing Law
Portuguese law applies, and Portuguese courts have jurisdiction, subject to mandatory consumer protection rules.
17) Changes
We may update these Terms. Updates will be published on philologica.com.
